This is not a lottery or raffle--it's a freebie.

ELIGIBILITY: FreeiPodGuy's contests are offered and available only to people who are 13 years of age or higher or if younger than 13, who have permission from a parent or guardian to enter and win; who are legal residents of the United States of America; who do not live in jurisdictions where such contests are prohibited; who are not family members of FreeiPodGuy; and who comply with all other requirements of these rules.

FREQUENCY OF CONTESTS: FreeiPodGuy will give away each prize at a point in time after the monies required to purchase the prize have been raised by the operation of the FreeiPodGuy.com website (the sources of monies potentially including but not necessarily limited to those raised through donations, advertising click-throughs, and affiliate programs). When possible, the date of the next contest will be announced in advance, but this may not always be possible due to the nature of the drawings.

HOW TO ENTER: Just fill out the entry form on the FreeiPodGuy.com website. You do not have to complete any offers, and you do not have to talk others into registering or completing offers. Cool, huh?

DRAWING: Unless otherwise described in the text of the FreeiPodGuy.com website, one winner will be randomly drawn from all eligible entries on the drawing date.

PRIZES & ODDS: FreeiPodGuy will choose at his sole discretion which iPod is given away. FreeiPodGuy may choose to offer other related prizes in addition to or instead of iPods, or to substitute other prizes of similar value to those offered. Odds of winning depend on the number of eligible entries received.

TAXES: Taxes are the sole responsibility of the winner.

MINORS: If the winner of a prize is a minor (as defined by the jurisdiction of winner's residence), the prize will be awarded to the minor's parent or legal guardian. The parent or guardian must agree to all terms of these rules and sign all required documents on behalf of himself/herself and the winner, or the prize will be forfeited and awarded to an alternate winner.

CLAIMING PRIZES: Following each drawing, the prize will be mailed, at FreeiPodGuy's expense, to the United States mailing address provided by the winner or their parent or legal guardian, only after FreeiPodGuy has received a Prize Claim Form completed by the winner or their parent or legal guardian. (A blank Prize Claim Form will be provided.) Winners or their parents or legal guardians (the if winner is a minor) must complete and return a Prize Claim Form within 14 days of notification. Failure to do so may result in disqualification with an alternate winner selected. Likewise, return of our prize notification or prize as non-deliverable may result in disqualification with an alternate winner selected. If the winner is found not to be in compliance with these rules or is otherwise ineligible, no prize for you!

FREQUENCY OF ENTRY: Each individual person may enter one time each day. Entrants who attempt to make multiple registrations under different names or e-mail addresses will be disqualified.

USE OF LIKENESS: By participating, where permitted by law the winner (and their parent or legal guardian if a minor) grant to FreeiPodGuy the right to publish the winner's name, likeness and biographical information (but not telephone or street address) in press releases or advertising materials and on the FreeiPodGuy.com website, without payment and without notification, review or approval.

INDEMNIFICATION: By participating, the winner (and their parent or legal guardian if a minor), release and agree to hold harmless the owner of the website and all affiliates and other related persons and entities, including advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person (including death) and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, or participation in FreeiPodGuy contests or in any of related activity. Besides, it wouldn't be nice to sue me, after all I've done for you.

DISQUALIFICATION: FreeiPodGuy reserves the right, at his sole discretion, to disqualify any entry or person it finds to be tampering with the entry process or the operation of the contest or web site; to be using ad-blocking tools, to be in violation of these rules; to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of entry methods that do not require the entrant to read the content of the FreeiPodGuy.com website will void all such entries by such methods and persons using any such methods will be disqualified. This includes entering for other people. (In other words, if you do it in a way that doesn't involve the possiblity of reading ads, no iPod for you!)

PREMATURE TERMINATION OF CONTEST: For any reason and at any time, FreeiPodGuy may, at his sole discretion, terminate any contest or the FreeiPodGuy.com website. In such an event, any pending drawings at the time of termination will not be held, and prizes pertinent to those drawings will not be awarded.

TAMPERING: Any attempt to deliberately damage the FreeiPodGuy.com website or undermine the legitimate operation of any contest is a violation of criminal and civil laws and should such an attempt be made, FreeiPodGuy reserves the right to seek damages or other remedies from those responsible to the fullest extent permitted by law.

LIMITATIONS OF LIABILITY: FreeiPodGuy is not responsible for late, lost, illegible, misdirected, stolen, or undelivered entries or mail, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the FreeiPodGuy.com website. FreeiPodGuy is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer hardware or software, failure of any e-mail or entry to be received by FreeiPodGuy on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof.

FreeiPodGuy is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by website users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the contest. FreeiPodGuy is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in any contest or downloading materials from or use of the FreeiPodGuy.com website.

In no event will the owner of the website or any affiliates or other related persons or entities, including advertising and promotion agencies or their respective directors, officers, employees, representatives or agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your participation in any contest, access to and use of the FreeiPodGuy website, or the downloading from and/or printing material downloaded. Without limiting the foregoing, everything on this site and in this promotion is provided "as is" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties so some of the above limitations or exclusions may not apply to you. DISPUTES: By participating, the winner (and their parent or legal guardian if a minor), agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with any contest, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering a contest), and participant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of the winner and FreeiPodGuy in connection with any contest, shall be governed by, and construed in accordance with, the laws of the State of Oregon, U.S.A., without giving effect to the conflict of laws or rules thereof, and all proceedings shall take place in that State in the City of Salem, County of Marion.

In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
